1. Our role
Biteqo ("we", "us", "the Platform"), operated from Lucknow, Uttar Pradesh, India, is an online directory of independent restaurants, cafés and food sellers ("Restaurants") and a software service through which a customer ("you") may send an order request directly to a Restaurant. Biteqo acts only as an intermediary / technology provider. We are not a restaurant, a food business operator, a seller of food, a delivery company or a payment aggregator, and no contract for the sale of food is formed between you and Biteqo.
2. Contract is between you and the Restaurant
Every order is a request made to the Restaurant. The contract for the sale and supply of food is entered into only between you and the Restaurant, when the Restaurant accepts your order. The Restaurant alone decides whether to accept, reject, change or cancel an order.
3. Food quality, safety and information
Restaurants are solely responsible for the quality, quantity, taste, freshness, hygiene, packaging, preparation and safety of the food they supply, for holding every licence and registration required by law (including FSSAI registration or licence), and for the accuracy of their menu, photographs, prices, taxes, descriptions, vegetarian / non-vegetarian marking, allergen information and opening hours. Biteqo does not inspect, test, verify or endorse any Restaurant or any dish, and does not guarantee that the information shown is complete or current. If you have an allergy or a medical or dietary need, please confirm the ingredients directly with the Restaurant before you order.
4. Conduct of Restaurants and their staff
Restaurants and their staff and delivery persons are independent of Biteqo. They are not our employees, agents or partners. We are not responsible for their behaviour, conduct, statements, delays, refusals, or any act or omission. Ratings and reviews are the personal opinions of customers and do not represent the views of Biteqo.
5. Delivery and pickup
Delivery, pickup and dine-in service are provided by the Restaurant, by its own staff or its own arrangements. Biteqo does not provide delivery services. Delivery areas, charges, minimum order values and delivery or preparation times shown on the Platform are set by the Restaurant, are estimates only, and are not guaranteed. Biteqo is not liable for late, missed, incorrect, damaged, spilled or undelivered orders.
6. Payments, refunds and cancellations
Biteqo does not collect or hold money for your order. Payment (cash, UPI or any other method the Restaurant offers) is made directly to the Restaurant, and any refund, replacement or compensation is a matter between you and the Restaurant under its own policy and applicable law. Where the Platform shows a UPI QR or payment link, it belongs to the Restaurant, and you should check the payee name before paying.
7. Limitation of liability
To the fullest extent permitted by law, Biteqo and its owners, directors, employees and affiliates shall not be liable for any direct, indirect, incidental, special or consequential loss, injury, illness, damage or expense arising from or connected with any food, service, delivery, conduct, price or information supplied by a Restaurant, or from your use of or inability to use the Platform, including interruptions, errors, or unauthorised access outside our reasonable control. Nothing in this disclaimer limits any right you have under the Consumer Protection Act, 2019 or any other law that cannot be excluded.
8. Availability and third-party links
The Platform is provided on an "as is" and "as available" basis. Notifications such as WhatsApp, SMS or e-mail depend on third-party services and may be delayed or fail. The Platform may link to websites, offers or services of others; we do not control them and are not responsible for them.
9. Complaints
For a complaint about food, service or delivery, please contact the Restaurant first, using the phone number on its page. If you face a problem with the Platform itself or want to report a Restaurant or a review, write to us on the Contact page and we will respond within a reasonable time. We may pass your complaint on to the Restaurant, and we may suspend a Restaurant that repeatedly breaks our rules.
10. Changes and governing law
We may update this disclaimer from time to time; the date above shows the latest version. By placing an order or using the Platform you confirm that you have read and accepted it. This disclaimer is governed by the laws of India, and the courts at Lucknow, Uttar Pradesh shall have jurisdiction, subject to any right you have as a consumer to approach a consumer forum.
This is a general statement prepared for the Platform. We recommend having it reviewed by your legal adviser before launch.
